Under Colorado Revised Statutes 16-5-401, a felony sexual assault generally has to be prosecuted within 20 years of the offence. If you were under 18 at the time, the 20 years run from your 18th birthday. If the identity of the accused is established by DNA and the offence was reported within 20 years, there is no time limit.

We quote this rather than shorten it. A shortened deadline is a wrong deadline, and this is the sentence a lawyer would want to read.

SANE exams can be completed up to 7 days after an assault, though evidence is easier to collect within 72 hours. Evidence is stored at minimum for the length of the statute of limitations for the crime. That gives you time to decide about reporting.

This is the clock that runs out fast. You can be examined without deciding whether to go to the police.

This is the deadline for the case itself — how long the law gives before a prosecution can no longer be brought. It is usually many years for rape, and often longer or unlimited when the survivor was a child.

Missing the exam window does not mean the limitation period has passed. They are separate clocks.
